Kano Emirate: Appeal Court Halts Sanusi’s Reinstatement, Awaits Supreme Court Ruling.

The Court of Appeal in Abuja has put a temporary hold on the enforcement of its judgment that upheld the Kano State Government’s repeal of the 2019 Emirate Council Law, pending the final determination of the case at the Supreme Court.

The ruling affects the reinstatement of Sanusi Lamido Sanusi as the 16th Emir of Kano, which was made following the Kano State Emirate Council (Repeal) Law 2024.

Appeal Court Overrules Federal High Court Decision

The Court of Appeal in Kano had earlier set aside the June 20, 2024, order by Justice Abubakar Liman of the Federal High Court, which had nullified all steps taken by the Kano State Government under the new Emirate Council Law.

However, the Kano State Government took the matter to the Supreme Court and filed an injunction at the Court of Appeal to stop the enforcement of the ruling until the apex court delivers a final judgment.

Legal Arguments and Court Ruling

A three-member panel of the Court of Appeal, led by Justice Okon Abang, ruled in favor of the applicant, Alhaji Aminu Babba Dan (Sarkin Dawaki Babba), who sought to restrain the respondents from implementing the judgment until the Supreme Court’s decision.

“The law is settled. The court is enjoined to exercise its discretion judiciously and in the interest of justice,” Justice Abang stated.

  • The court ordered a return to the status quo, meaning that the January 10 judgment nullifying the dissolution of the new emirates remains unenforceable until the Supreme Court rules on the case.
