JUST IN: Court Sets June 19 for Judgment in N550m Suit Against Nigerian Army Over Brutal Assault Claim.

The Federal High Court in Abuja has fixed June 19, 2025, for the final judgment in a N550 million fundamental human rights lawsuit filed against the Nigerian Army, the Chief of Army Staff (COAS), and six other respondents.

The case, brought by Mr. Ambrose Akhigbe, an Assistant Director at Command Secondary School, Ipaja, Lagos, involves allegations of assault, battery, attempted murder, and gross human rights violations.

Justice Joyce Abdulmalik announced the date after hearing the applicant’s counsel adopt his final written address. The court had earlier ordered service of the suit via newspaper publication, due to the army’s failure to respond directly.

According to court filings, Akhigbe accused military personnel (5th to 8th respondents) of violently attacking him for allegedly recording a video showing students being subjected to degrading punishment—forced to roll in muddy water.

He described how the soldiers beat him with planks, sticks, iron rods, and a koboko, targeting his face and neck while threatening to kill him.

The plaintiff claimed the attack left him with a severe head injury, forcing the school to halt academic activities as staff protested the brutal treatment. Video evidence was tendered in court to support his claim.

  • In his legal demands, Akhigbe is seeking:
  • N500 million as compensation for the violation of his constitutional rights
  • N50 million in legal costs
  • A perpetual injunction preventing further harassment
  • A public video apology aired on two national TV stations

The plaintiff’s legal team has urged the court to grant all reliefs, emphasizing violations of Sections 34(1) and 33(1) of the Nigerian Constitution, and Articles 4 and 5 of the African Charter on Human and Peoples’ Rights.
