The Federal High Court in Abuja has rejected the no-case submission filed by Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), ruling that the prosecution has established a prima facie case against him.
Delivering judgment on Friday, Justice James Omotosho held that the Department of State Services (DSS), through the testimonies of five witnesses, presented sufficient evidence requiring Kanu to enter his defence in the ongoing terrorism and treasonable felony trial.

- “This is not to say the defendant is guilty as charged, but he is entitled to a fair hearing to prove his innocence. The defendant remains innocent until proven guilty, and the prosecution must still prove its allegations beyond reasonable doubt,” Justice Omotosho ruled.
The judge further noted that Kanu’s legal team failed to provide proof of his alleged extraordinary rendition to Nigeria.
Accordingly, the court dismissed the no-case submission, insisting that Kanu must respond to the weight of evidence presented against him.
Medical Examination Ordered by Court
In a related ruling, Justice Omotosho directed the Nigerian Medical Association (NMA) to set up an independent panel of eight to ten medical experts, including a cardiologist and neurologist, to assess Kanu’s health condition.
The panel is expected to:
- Submit a report within eight days.
- Evaluate the capacity of the DSS hospital to manage its health needs.
- Consider treatment in any suitable hospital within Nigeria if necessary.
- Include the Chief Medical Director of the National Hospital as part of the team.

This decision follows conflicting medical reports presented by DSS doctors and Kanu’s private medical consultants, led by Professor Martin Aghaji, who recommended urgent treatment at the National Hospital, Abuja, or possibly abroad.
While the DSS maintained that its facilities are capable of handling Kanu’s condition, Kanu’s lead counsel, Dr Onyechi Ikpeazu, insisted that the transfer request was in the interest of justice and necessary to ensure his client remains alive to face trial.
The matter has been adjourned until October 8, 2025, for continuation of proceedings.
