ABUJA — July 2, 2025 —
The Supreme Court of Nigeria has reserved its judgment in the appeal filed by the Peoples Democratic Party (PDP) and its candidate, Asue Ighodalo (SAN), challenging the outcome of the 2024 Edo State Governorship Election, which declared Senator Monday Okpebholo of the All Progressives Congress (APC) as the winner.
A five-member panel of justices, led by Justice Mohammed Garba, stated that judgment would be delivered at a later date, which would be duly communicated to the involved parties.
⚖ Ighodalo Appeals to Apex Court for Victory Declaration
Ighodalo and the PDP are seeking to overturn the May 29, 2025, Court of Appeal judgment, which affirmed the April 2 tribunal decision in favor of Okpebholo. The appellants’ legal counsel, Ken Mozia (SAN), urged the apex court to declare Ighodalo the lawful winner, claiming he secured the majority of valid votes cast in the September 21, 2024, election.
🛑 APC, INEC Urge Supreme Court to Dismiss Appeal
Opposing the appeal, Kanu Agabi (SAN) representing INEC, and Emmanuel Ukala (SAN) for the APC, both called for a dismissal of the appeal, maintaining that the lower courts had ruled correctly and that there was no proven case of electoral malpractice.

The lead judgment by Justice Olabode Abimbola Adegbehingbe at the Court of Appeal had dismissed Ighodalo’s case, ruling that:
- The appellants failed to prove allegations of non-compliance and over-voting.
- Only 19 witnesses were called, and most did not witness incidents at the polling units.
- The appellants did not tender voters’ registers to support claims of over-voting.
- 14 witnesses gave hearsay evidence, not based on personal experience at polling stations.
